Ty Ross Out??

Loudon City manager, Ty Ross, may not be out of a job yet, but looks like he's got one foot out the door with the other foot on a banana peel.

At Monday's Loudon City council meeting, it's a bit unclear as to what really happened. Three of the five voting members voted to remove city manager, Ty Ross, from his position as city manager. He would continue as the utility board manager.

Toward the end of the meeting, councilman, Tim Brewster, pointed out that the vote on Ross' position was suppose to have been on the agenda but, for some reason, left off. Brewster then made the motion to remove Ross as city manager.  Immediately, mayor Jeff Harris, told Brewster his motion was out of order since the matter wasn't on the agenda. Harris was backed up by city attorney, Kris Frye. Brewster disagreed stating, he had read Roberts Rules, and left his motion on the floor. He received a second on his motion from councilman Johnny James.

Harris stated that there would have to be a unanimous vote of the council to add it to the agenda at which point Brewster reiterated his motion to remove Ross. Harris then called for the vote which passed by a vote of 3-2 in favor of removal which is a majority vote. Councilwoman, Tammy Bivens voted with Brewster and James. Harris declared the vote failed because it wasn't unanimous. Problem is, the vote was for removal not to add it to the agenda.

Unless the council had a policy in place, for or against adding agenda items, technically,  the vote to remove Ross was ligament and stands.

Rather than belabor the point of who's right and who's wrong on the agenda question, council will hold a special called meeting on July 6th, to vote on the Ross position.
