McNabb vs Harrison

Friday's hearing on Lenoir City judge, Robin McNabb's, request to prevent Lenoir City judge elect, Greg Harrison, from taking office on September 1st, was denied by Judge, Mike Pemberton.

McNabb's challenge was twofold. First, Ms. McNabb is challenging his qualification to hold the office since he is not a Lenoir City resident. 2nd, she was asking for an emergency restraining order to prevent Harrison from taking office on September 1st claiming it would cause "immediate and irreparable harm and injury". McNabb's argument was that if Harrison takes office and later is ruled ineligible, cases heard and decided by him could have grounds to request retrials. Also, Ms. McNabb stated that she would be personally injured by loss of income.

Ultimately, Pemberton denied the restraining order citing the lack evidence that there would be "immediate and irreparable harm" if Harrison takes office on September 1st. This clears the way for Harrison to assume office. 

The case of McNabb vs Harrison will continue and must be heard by the court within 50 days. McNabb represented herself. Harrison was represented by none other than T. Scott Jones.

Based on the arguments before the judge, it certainly sounds like McNabb has a very strong case. She is making a constitutional challenge to Harrison's residency. It was stated clearly today that a city ordinance does not trump the state constitution.

If Harrison is removed from the judge's position by the court, it would be up to the city council to make an appointment to fill the vacancy until August 2024. If Harrison is allowed to remain in office, his term runs to 2030.
