‘Habitual offender’ nabbed on DUI

A Lenoir City man was taken to Loudon County Jail on multiple charges after initially getting stopped for speeding.

On patrol about 8 p.m. Sunday, Tennessee Highway Patrol Trooper James Capps recorded a white Pontiac going 81 mph in a 45 mph zone. After turning on his lights and following the vehicle, Capps noticed that the driver, Albert Lee McCowan, 53, Niota, was “very slow to stop, and he finally came to a stop on Wheeler Circle.”

“On Wheeler Circle the subject threw a can of Bud Light out of the driver’s side window,” Capps wrote, noting that McCowan displayed signs of intoxication, and McCowan performed poorly on field sobriety tests.

Capps, who described McCowan as an “habitual offender,” said the man’s license was revoked in April 2013 out of McMinn County, and his last driving under the influence conviction was in October 2014 in Meigs County. Capps said the man has an “extensive history” of DUI and driving on a revoked license charges in Meigs, Monroe and McMinn counties.

McCowan refused a mandatory blood draw and was taken to a Sweetwater emergency management station for the test.

McCowan was charged with driving under the influence-third offense, driving on a revoked license-14th offense and violation of implied consent and held on $10,000 bond.

Brothers charged in backseat altercation

A pair of brothers from Loudon were charged with domestic assault stemming from a dispute in the backseat of a car.

Dispatched to a call of a fight in progress in the 1100 block of U.S. Highway 321, Lenoir City Police Officer Tim Holloway spoke with brothers, Christopher Neil Gracie, 29, Loudon, and James Tyler Gracie, 24, Loudon, who said they were arguing in the backseat of a car with their mother seated between them. 

“Christopher stated (that) James struck him first and James stated Christopher struck him first,” Holloway wrote. “Both persons admitted to striking the other; however, no other witness was able to state who was the primary aggressor.” 

Both brothers had minor injuries, and each told police they acted in self-defense, Holloway wrote. The brothers’ mother told police that she was caught in the middle and was not able to say which sibling struck first.

Christopher Gracie was charged with domestic assault and released on $1,000 bond.

James Gracie was charged with domestic assault and released on $1,000 bond.

Aug. 27

• Mitchell Owen Brown, 32, Lenoir City, was charged with burglary and theft under $500 and released on $9,500 bond.

• Paul Lester Dailey, 33, Loudon, was charged with violation of probation-third offense and held without bond.

• Jesse Paul Mathis, 21, Lenoir City, was charged with theft over $500 and released on $5,000 bond.

• Joshua Alan Underwood, 28, Loudon, was charged with driving on a revoked license-second offense, failure to appear and released on $8,000 bond.

• Deanna Lillian Aloise, 42, Knoxville, was charged with failure to appear-general sessions and held without bond.

• Brandon Christopher Hall, 18, Loudon, was charged with underage consumption and held on $1,000 bond.

• Barbara Faye Hart, 67, Lenoir City, was charged with making false reports/statements and held on $7,500 bond.

• Larry Lynn Rasar, 56, Greenback, was charged with public intoxication and held on $1,000 bond.

Aug. 28

• Samuel Douglas Branum, 21, Philadelphia, was charged with public intoxication, two counts of attachment-juvenile court and violation of probation and held on $1,300 bond. Responding to a call of a disturbance in the 700 block of Spring Street, Loudon County Sheriff’s Office Sgt. Michael Watkins arrived to find multiple individuals being “very loud” on a porch. He wrote in his report that one man, Branum, was unsteady on his feet and displayed signs of intoxication as he came off the porch. Other individuals on the porch told Watkins that the man came to the home and “appeared to be very intoxicated, was cursing, and throwing gang signs and they had asked him to leave and he refused,” Watkins wrote. Branum “became combative” and pushed two women, who refused to report the incident, according to the arrest report. Branum was found to have two attachments out of juvenile court.

• Manuel Flores Cuellar, 74, Loudon, was charged with domestic assault and released on $1,000 bond. Responding to a call of a dispute in the 900 block of Vale Street, Loudon Police Officer Kenny Ridings spoke with a man, who said his grandfather was “shaking his grandmother violently,” according to the arrest report. Ridings wrote that he saw red marks on the woman’s arms, and she told police that her husband, Cuellar, grabbed and shook her before her grandson broke up the dispute.

• Lisa Malia Davidson, 52, Lenoir City, was charged with domestic assault and released on $1,000 bond. Responding to a call of a dispute in the 2500 block of Browder Hollow Road, Lenoir City Police Officer Jamie Whitt spoke with a woman, Davidson, who said she and her daughter got into an argument over a book that she brought home for her grandson and told her daughter not to open, according to the arrest report. “(The daughter) did open the book and they began to argue and she called her mother a bitch,” Whitt wrote. “Lisa then smacked her on the right cheek.” The daughter also told police that Davidson pulled out her earring.

Aug. 29

• Jimmy Lynn Arden III, 27, Lenoir City, was charged with domestic assault and released on $2,000 bond. Dispatched to a call of a male assaulting a female at a gas station on U.S. Highway 321, police spoke with a woman and her boyfriend, Arden, both of whom told police they had been involved in an altercation while walking down the road. According to police, Arden struck the woman and knocked her to the ground, and she had red marks on her legs from the fall.

• Jimmy Lynn Arden Jr., 50, Lenoir City, was charged with driving on a suspended license and released on $1,000 bond.

• Christopher Michael Bertram, 27, Kingston, was charged with aggravated burglary and held on $15,000 bond.

• Bradley Joe Bragg, 23, Sweetwater, was charged with driving on a revoked license and released on $4,000 bond.

• James Edward Dockery, 60, Greenback, was charged with domestic assault and released on $4,000 bond.

• Charles Ray Dowling, 59, homeless, was charged with public intoxication and held on $283 bond. Dispatched to a call of a possible intoxicated person at a restaurant on U.S. Highway 321, police found Dowling, who displayed signs of intoxication, according to the arrest report. Dowling admitted to police that he had been drinking that day.

• Richard Darren Queen, 43, Lenoir City, was charged with violation of probation and released on $2,000 bond.

• Abigail Joann Turkett, 30, Lenoir City, was charged with violation of probation and held on $2,000 bond.

Aug. 30

• Thomas Mason Cratty, 24, Loudon, was charged with two counts of theft under $500 and violation of probation-criminal court and held without bond. Dispatched to a call of a shoplifter at a retail store on U.S. Highway 321, Lenoir City Police Officer Tim Holloway spoke with loss prevention employees, who said Cratty entered the store and took “multiple electronic items” and left the store without paying for the merchandise. Cratty later entered the store, returned the items and received a gift card for $248.50 and $21.67 in cash. Police found that Cratty had a previous arrest warrant for theft under $500 stemming from an incident at another retail store.

• Denise Nicole Davis, 37, Lenoir City, was charged with domestic assault and released on $1,000 bond. A man told police that he and his girlfriend had gotten into an argument “because she woke up in a bad mood,” according to Lenoir City Police Office Jamie Whitt. The man said the woman, Davis, hit him in the face and ripped his shirt. Whitt wrote that the man’s shirt was ripped, and he had a small scratch beside his left ear.

• Larry Lynn Davis, 27, Greenback, was charged with child support and held without bond.

• Jose Cisneros Guzman, 27, Lenoir City, was charged with driving under the influence and released on $1,000 bond.

• Edward Norman Olsen, 22, Lenoir City, was charged with driving under the influence and held without bond.

Aug. 31

• Christopher Lynn Arwood, 37, homeless, was charged with public intoxication and released on $1,000 bond.

• Carlos Marco Clark-Morales, 43, Lenoir City, was charged with driving under the influence and released on $1,000 bond. Responding to a call of a wreck with no injuries in the 1100 block of Foster Drive, LCSO Deputy Brian Smith learned that the driver of a Honda Accord had run into the woods away from the scene of the wreck. Locating a man matching the description walking in the woods, Smith spoke with Clark-Morales, who told police that he had been in a wreck and had four beers. Smith said Clark-Morales displayed signs of intoxication but was unable to perform field sobriety tests “due to a language barrier.” After being transported to Loudon County Jail, Clark-Morales was read the Spanish version of Tennessee implied consent law and agreed to a breathalyzer test. Clark-Morales’ blood alcohol level was at 0.213, according to police.

• Joshua Stephen Hatfield, 30, Knoxville, was charged with criminal court capias and held on $3,000 bond.

• Gary Wayne Ivey, 45, Loudon, was charged with driving on a suspended license and released on $1,000 bond.
