We went before the judge today in the case regarding the land transfer.
 
The city rejected a deal of the land being returned on the condition that Thomas Peeler only be responsible for $1500 of the $9000 legal cost accrued in the case thus far with the clause that we sign off on any future claims against Mr. Peeler for anything regarding past city business during his tenure as mayor. 

We were not comfortable accepting this. We feel that our citizens should not pay for something they had no part in.

Our attorney ,Melanie Davis , moved to have Jim Scott removed as the defense attorney due to the fact that he was the attorney representing the city when Mr. Peeler was mayor and now is representing the fire department (which Mr. Peeler is on the board of ) against the same city he represented. Citing the chance that Mr. Scott May need to be called as a witness in the case.
 

Mr. Scott stated that he had never discussed a land transfer during his time as city retained council and was unaware any land transfer had happened until this case occurred.
 

The judge has now given both sides the charge of beginning discovery proceedings in preparation for trial.
 

We appreciate your patience with us on this.

We have tried our best to prevent having to call in the State of Tn. comptrollers office for a full audit on all past real estate transfers and financial dealings of the city. However, we will need to do so before relinquishing the right to future claims against Mr. Peeler.
 
We are currently reviewing all deed transfers, including quit claim deeds, purchases, leases , etc. in the history of the town to be sure they have all been properly executed and will be making those available to you. This will take some time but we will let you know when we have it all together.
 

This matter will be on the agenda for the August 13 2019 city council meeting.
